Terms of Service

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and Airman2Go ("we," "us," or "our") governing your access to and use of the Airman2Go mobile application, website, and related services (collectively, the "Platform").

1. Description of Services

Airman2Go is a technology platform that connects riders seeking transportation with independent, volunteer drivers within military communities. We facilitate ride-sharing connections through our mobile application and bidding system.

Our services include:

• A bidding marketplace where riders set prices and drivers bid on ride requests
• Secure in-app payment processing through Stripe
• Real-time GPS tracking during active rides
• In-app messaging between matched riders and drivers
• Driver and rider mutual rating and reliability systems
• Scheduled and immediate ride request options

2. Eligibility

To use Airman2Go, you must meet ALL of the following requirements:

• Age: You must be at least 18 years of age
• Military affiliation: You must be an active-duty military service member, military dependent, military retiree, or authorized DoD personnel with valid identification
• Identity verification: You must complete Common Access Card (CAC) or military ID verification as part of the onboarding process
• Legal capacity: You must have the legal capacity to enter into binding agreements
• Geographic eligibility: You must be located within or near a supported military installation

Airman2Go is open to personnel from all branches of the United States Armed Forces, including Air Force, Army, Navy, Marine Corps, Space Force, and Coast Guard, as well as their authorized dependents and family members.

3. Account Registration & Security

When creating an account, you agree to:

• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information as needed
• Maintain the security of your password and account credentials
• Accept responsibility for all activity that occurs under your account
• Notify us immediately of any unauthorized access or security breach
• Not create more than one account per individual
• Not share your account with or transfer it to any other person

We reserve the right to suspend or terminate accounts that contain inaccurate information or are used in violation of these Terms.

4. The Bidding System

Airman2Go uses a unique bidding system for ride pricing:

1. Rider sets an offered price: When requesting a ride, the rider proposes a fare they are willing to pay for the trip
2. Drivers review and bid: Nearby available drivers see the ride request (including approximate pickup area, destination, and offered price) and may accept the offered price or submit a counter-offer
3. Rider selects a bid: The rider reviews incoming bids and selects the driver and price they prefer
4. Payment is authorized: Once a bid is accepted, payment is authorized for the agreed amount

You understand and agree that:

• Prices are determined by mutual agreement between riders and drivers, not by Airman2Go
• There is no guarantee that any ride request will receive bids or that any bid will be accepted
• Airman2Go does not set, regulate, or control ride pricing beyond providing the marketplace
• For immediate rides, the bidding window is 15 minutes from the time of request
• For scheduled rides, bidding remains open until 30 minutes before the scheduled pickup time

5. Payments, Fees & Billing

All payments are processed securely through Stripe, Inc., a PCI-DSS Level 1 certified payment processor. By using Airman2Go, you also agree to Stripe's Terms of Service.

Payment Terms:

• Riders: Payment is authorized at the time of bid acceptance and captured upon ride completion. You must maintain a valid payment method on file to request rides.
• Drivers: Earnings are deposited to your connected Stripe Express account. Payout timing is governed by Stripe's standard schedule.
• Refunds: If a ride is cancelled before a driver is assigned, no charge is incurred. For disputes after ride completion, contact us at support@airman2go.com.

6. Cancellation Policy & Fees

Rider Cancellations:

• Before a bid is accepted: Free cancellation with no penalty
• After a driver is assigned (before arrival): A cancellation fee of $2.00 may be charged. This is recorded as a minor infraction on your rider reliability record.
• After the driver has arrived at pickup: A cancellation fee of $5.00 may be charged. This is recorded as a major infraction on your rider reliability record.

Rider No-Show:

• If you fail to appear at the pickup location within a reasonable time after the driver arrives, the driver may report a no-show. This results in a major infraction on your reliability record and may incur the full ride fare.

Driver Cancellations:

• Drivers may cancel an accepted ride, but repeated cancellations will result in infractions on the driver's reliability record and potential suspension from the platform

Scheduled Ride Cancellations:

• Riders may cancel a scheduled ride without penalty up to 30 minutes before the scheduled pickup time
• Late cancellations of scheduled rides are subject to the same fees as immediate ride cancellations

7. Driver Requirements & Responsibilities

To operate as a driver on Airman2Go, you must:

• Submit a driver application and be approved by Airman2Go administrators
• Hold a valid driver's license recognized in the jurisdiction where you operate
• Maintain current automobile insurance that meets local minimum requirements
• Operate a vehicle that is in safe, roadworthy condition
• Complete and sign the Airman2Go driver agreement and liability waiver
• Connect a Stripe Express account for receiving payouts

As a driver, you agree to:

• Operate your vehicle safely and in compliance with all applicable traffic laws
• Not operate your vehicle under the influence of alcohol, drugs, or any impairing substance
• Treat all riders with respect and courtesy
• Proceed directly to the rider's destination via a reasonable route
• Maintain a clean and comfortable vehicle for riders
• Not discriminate against riders based on race, gender, religion, national origin, disability, sexual orientation, or any other protected characteristic

8. Rider Responsibilities

As a rider, you agree to:

• Be present at the designated pickup location at the agreed time
• Wear seatbelts at all times during the ride
• Treat drivers and their vehicles with respect
• Not bring open containers of alcohol or illegal substances into the vehicle
• Not smoke or vape in the vehicle
• Be responsible for any damage you or your guests cause to the driver's vehicle
• Not request rides for individuals under 18 who are unaccompanied by an adult
• Provide accurate pickup and destination information
• Not discriminate against drivers based on any protected characteristic

9. Ratings & Reviews

Airman2Go uses a mutual rating system to maintain community quality and safety:

• After each completed ride: Riders rate drivers (1-5 stars) and drivers rate riders (1-5 stars)
• Average ratings are calculated from all completed rides and displayed to other users
• Ratings are intended to reflect the actual experience and should be honest and fair
• Retaliatory ratings, fraudulent ratings, or rating manipulation is prohibited

Users with consistently low ratings may have their accounts reviewed and may face restrictions or deactivation.

10. Reliability System

Airman2Go operates a reliability system for both drivers and riders to ensure platform integrity:

• Infractions: Certain actions (late cancellations, no-shows, safety violations) are recorded as infractions with point values
• Minor infractions (e.g., cancellation after driver assignment) carry fewer points
• Major infractions (e.g., no-show, cancellation after driver arrival) carry more points
• Automatic suspension: Accumulating infraction points above defined thresholds may result in temporary suspension from the platform (ranging from 7 to 90 days depending on severity)
• Points reset on a rolling window basis; older infractions eventually expire

Platform administrators may also impose manual suspensions or restrictions at their discretion for violations of these Terms or safety concerns.

11. In-App Communications

Airman2Go provides in-app messaging between matched riders and drivers during active rides. You agree that:

• In-app messages are for ride coordination purposes only
• You will not send harassing, threatening, abusive, or discriminatory messages
• You will not share illegal or inappropriate content
• Chat messages are retained for 30 days after ride completion for safety and dispute resolution, then permanently deleted
• Airman2Go administrators may access chat logs when investigating reported safety incidents or disputes

12. Location Data & Geofencing

Airman2Go requires location data to function:

• Riders: Location is used to set your pickup point, calculate distances, and verify you are within a supported service area
• Drivers: Real-time location is shared with riders during active rides and used to match you with nearby ride requests
• Geofencing: Ride requests must originate from or be destined for areas within or near supported military installations

You may disable location permissions at any time, but this will prevent you from using ride-related features. For full details on how location data is collected and used, see our Privacy Policy.

13. Prohibited Conduct

You agree NOT to:

• Use the Platform for any unlawful purpose or in violation of any applicable laws
• Impersonate another person or misrepresent your military affiliation
• Create multiple accounts or use another person's account
• Harass, threaten, or discriminate against any user
• Transport illegal goods, weapons, or controlled substances via the Platform
• Attempt to circumvent the Platform's payment system (e.g., arranging off-platform payments)
• Manipulate ratings, create fake ride requests, or engage in bid manipulation
• Reverse-engineer, decompile, or attempt to extract the source code of our application
• Use the Platform in any way that could damage, disable, or impair our servers or infrastructure
• Collect or harvest personal information of other users without consent
• Use the Platform for commercial transportation services outside of legitimate ride-sharing
• Share location data, ride patterns, or user information that could compromise operational security (OPSEC) of military personnel or installations

14. Confidentiality & OPSEC

Users also share a responsibility in maintaining OPSEC:

• Do not share screenshots or details of other users' profiles or rides on social media
• Do not discuss sensitive military information with your driver or rider
• Be mindful that ride patterns could reveal sensitive information about military routines

15. Insurance & Liability

You acknowledge and agree that:

• Airman2Go does NOT provide automobile insurance, commercial rideshare insurance, or any form of transportation liability coverage
• Drivers are responsible for maintaining their own automobile insurance and ensuring it covers their activity on the Platform
• Riders assume the risk inherent in accepting rides from independent drivers who are not professionally licensed commercial operators
• In the event of an accident, injury, or property damage during a ride, responsibility lies with the parties involved and their respective insurance coverage — not with Airman2Go
• Airman2Go is a technology platform, not a transportation company, and bears no liability for incidents occurring during rides

16. Intellectual Property

All content, features, functionality, trademarks, service marks, trade names, logos, and visual design of the Airman2Go Platform are the exclusive property of Airman2Go and are protected by applicable intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Platform for personal, non-commercial purposes in accordance with these Terms.

17. Disclaimers

THE PLATFORM IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. TO THE FULLEST EXTENT PERMITTED BY LAW, AIRMAN2GO DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT
• ANY WARRANTY THAT THE PLATFORM WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE
• ANY WARRANTY REGARDING THE QUALITY, SAFETY, LEGALITY, OR SUITABILITY OF DRIVERS, VEHICLES, OR RIDES
• ANY WARRANTY REGARDING THE ACCURACY OR RELIABILITY OF ANY INFORMATION PROVIDED THROUGH THE PLATFORM

We do not guarantee the availability of drivers in your area or that ride requests will be fulfilled.

18. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

• AIRMAN2GO SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL
• AIRMAN2GO'S TOTAL AGGREGATE LIABILITY FOR ANY CLAIMS ARISING FROM OR RELATED TO THESE TERMS OR YOUR USE OF THE PLATFORM SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO AIRMAN2GO IN THE 12 MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100.00)
• AIRMAN2GO IS NOT LIABLE FOR ANY PERSONAL INJURY, PROPERTY DAMAGE, OR OTHER HARM ARISING FROM RIDES ARRANGED THROUGH THE PLATFORM

Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, our liability is limited to the fullest extent permitted by law.

19. Indemnification

You agree to indemnify, defend, and hold harmless Airman2Go, its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorney's fees) arising from or related to:

• Your use of or inability to use the Platform
• Your violation of these Terms
• Your violation of any applicable law or regulation
• Your violation of any rights of a third party
• Any ride in which you participated as a driver or rider
• Any content you submit or transmit through the Platform

20. Dispute Resolution

Informal Resolution First: Before filing any formal claim, you agree to contact us at support@airman2go.com and attempt to resolve any dispute informally for at least 30 days.

Ride Disputes: For disputes regarding specific rides (fare disagreements, service quality issues), submit a dispute through the app or via email within 7 days of the ride.

Payment Disputes: Payment disputes are handled through Stripe's dispute resolution process. You may also contact us directly for assistance.

21. International Operations & Compliance

Airman2Go operates at military installations worldwide, including in the European Union (Germany, among others). This means:

• GDPR Compliance: For users located in the European Economic Area (EEA), your data is processed in accordance with the General Data Protection Regulation (GDPR). See our Privacy Policy for full details.
• Status of Forces Agreement (SOFA): U.S. military personnel overseas may have specific legal status under applicable SOFA agreements. These Terms do not supersede or modify any rights or obligations under SOFA.
• Local Laws: You are responsible for ensuring your use of the Platform complies with all laws applicable to you, including local traffic laws, insurance requirements, and data protection regulations.
• Data Transfer: Your data may be transferred to and processed in the United States. We implement appropriate safeguards for international data transfers as described in our Privacy Policy.

22. Account Suspension & Termination

By Airman2Go: We may suspend, restrict, or terminate your account at any time if we reasonably believe you have:

• Violated these Terms or any applicable law
• Engaged in conduct that poses a safety risk to other users
• Provided false or misleading information
• Accumulated excessive reliability infractions
• Received consistently low ratings below our minimum threshold
• Engaged in fraud or abuse of the Platform

By You: You may deactivate your account at any time through the app or by submitting a request at airman2go.com/request-removal.

Effect of Termination: Upon termination, your right to use the Platform ceases immediately. Any pending payments owed to you will be processed. Sections of these Terms that by their nature should survive termination will continue in effect.

23. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will post the updated Terms on this page and notify you via push notification or email for significant changes.

Your continued use of the Platform after changes are posted constitutes your acceptance of the updated Terms.

24. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States. For users outside the United States, local mandatory consumer protection laws may also apply to the extent they cannot be waived by contract.

25. General Provisions

• Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and Airman2Go regarding use of the Platform
• Severability: If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect
• No Waiver: Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision
• Assignment: You may not assign or transfer these Terms without our prior written consent. We may assign these Terms without restriction
• Force Majeure: Airman2Go shall not be liable for any failure to perform due to circumstances beyond our reasonable control, including natural disasters, military operations, government actions, or infrastructure failures
• No Agency: Nothing in these Terms creates a partnership, joint venture, agency, or employment relationship between you and Airman2Go
